looking after your information

We're Momentum Group — an independent media agency based in Ponsonby, Auckland. Whether you're a client, a supplier, someone who's filled in a form on our website, or just having a look around, we want you to know what happens to any personal information you share with us.

This policy explains, in plain language, what we collect, why we collect it, who we share it with, and the choices you have. We handle personal information in line with the Privacy Act 2020, the law that sets the rules for how organisations in New Zealand look after people's information.

A quick note on our client work: A lot of what we do involves handling data on behalf of the brands we work with, including through our Accelerator™ platform. In those cases, the client usually decides how that information is used, under their own privacy terms, and we follow their instructions. This policy is about how we handle information through our website and our direct dealings with you. Our platforms and services may carry their own separate terms.

what we collect

The information we hold about you depends on how you've dealt with us. It can include:

  • Your contact details — your name, the organisation you work for, your role, email, phone number and address.
  • Anything you send us — when you fill in a form, ask us a question, respond to a proposal, sign up for updates, or work with us on a project.
  • Business information — the details we need to manage a project or relationship, like briefs, contracts and billing.
  • Technical information — collected automatically when you visit our website, like your IP address, the type of device and browser you're using, and which pages you looked at (more on that under Cookies and analytics).

We don't collect sensitive information on our website, so please don't send it to us unless we've specifically asked for it.

how we collect it

Most of the time, we collect information in one of three ways:

  • Straight from you — when you contact us, fill in a form, or work with us.
  • Automatically — through cookies when you visit our website.
  • From other places — sometimes we get information about you from somewhere other than you directly. That might be a public source, one of our clients, a business partner, a referral, or a data or audience provider we use as part of our media and analytics work.

why we collect it

We use your information to run our business and work with you. That means things like:

  • answering your questions and staying in touch;
  • planning, buying and delivering media, data, technology and analytics work;
  • managing our relationships with clients, suppliers and contractors — contracts, billing and the day-to-day;
  • keeping our website running well and understanding how people use it;
  • sending you updates or marketing if you've asked for them, or where we're allowed to (you can stop these anytime);
  • meeting our legal and professional obligations; and
  • protecting our people, systems and rights.

We'll only use your information for the reason we collected it, something closely related, or where the law allows.

Like most websites, ours uses cookies — small files that sit on your device and help the site work, remember your preferences, and show us how people are using it.

We may also use third-party analytics tools to understand our website traffic.

You're in control of cookies through your browser settings, and you can turn them off — though a few parts of the site might not work as well if you do.

who we share it with

We share information only where we need to, and only with people who'll look after it. That can include:

  • our team, contractors and related companies who need it to do their jobs;
  • the providers who help us run the business — IT, hosting, cloud storage, finance, marketing and professional advisers — who can only use it for what we've asked them to do;
  • media owners, platforms and partners, where that's needed to deliver work for you or your organisation;
  • our clients, where the information relates to work we're doing for them;
  • anyone involved in a sale or restructure of our business; and
  • government agencies, regulators or courts, where the law requires it or where we need to protect our rights or safety.

We don't sell your personal information.

sending information overseas

Some of the tools and providers we rely on — like cloud hosting and analytics platforms — are based overseas or store information outside New Zealand. So your information may end up being held or processed in another country.

When that happens, we take reasonable steps to make sure it's protected to a standard comparable with the New Zealand Privacy Act 2020.

keeping your information safe

We hold your information electronically and, where we need to, on paper. We use sensible security measures to protect it — things like access controls, secure systems and trusted providers.

We'll be straight with you: no website or electronic storage is ever completely secure. We do everything reasonable to protect your information, but we can't promise it's impossible for anything to go wrong.

how long we keep it

We keep your information only as long as we need it for the reasons in this policy, or as long as the law requires (for example, tax and business records). After that, we securely get rid of it or strip out anything that identifies you.

your information, your rights

Under the Privacy Act 2020, you can:

  • ask to see the personal information we hold about you; and
  • ask us to correct it if you think it's wrong, out of date or incomplete.

Just get in touch. We might need to check who you are first, and then we'll get back to you as quickly as we can — within the timeframes set by the Privacy Act. There's usually no charge; if we ever need to charge a small fee, we'll tell you before we do.

marketing and your choices

If you're getting marketing from us and you'd rather not, you can opt out anytime using the unsubscribe link or by telling us directly. We may still send you the occasional message about your account or the work we're doing together, since those aren't marketing.

Our website might link out to other sites. Once you've left our site, we can't take responsibility for how those sites handle your information — so it's worth reading their privacy policies too.

We'll update this policy from time to time as our business or the law changes. The latest version is always available here on our website, and the "Last updated" date at the top shows when we last updated it.
